A judge on Monday found probable cause to continue the prosecution of a young woman accused of kidnapping a family friend's baby.

Jessenia Saldana, 22, is charged with kidnapping. Police say she took two-year-old Alizae Mata with the child's mother's permission last Wednesday to run errands but never bought the child back home.

An Amber Alert was issued, and police arrested Saldana in southeast Houston the next day. Alizae was not harmed.

Despite the charge, Saldana held her head high inside the courtroom. Her attorney, Bryan Savoy, calls the incident a misunderstanding.

"As in previous situations, Ms. Saldana has been acting as a babysitter, and on this occasion, she was doing the same thing and there was no kidnapping," Savoy said.

Her attorney went on to say he expects the charges will be dismissed.
