An accused cop killer has a court appearance scheduled for today, but he is still in the hospital and will likely not come face to face with a judge.

Harlem Harold Lewis, 21, has been charged with capital murder of a police officer and murder. He's accused killing Sergeant Jimmie Norman during a shootout on Christmas Eve.

An innocent bystander, 66-year-old Terry Taylor was also shot and killed, allegedly by Lewis, when he tried to help Sgt. Norman.

It's still not clear if District Attorney Mike Anderson will seek the death penalty.
