Injured boy to remain in CPS custody

MAGNOLIA, TX

A court hearing this morning determined that CPS should remain the conservator for five-year-old Michael Spurlock. The little boy is still in the intensive care unit after investigators say his mother cut his throat, stabbed and severely beat him.

Daphne Spurlock is charged with attempted capital murder. Her husband told police his wife believed the child was possessed. No bond has been set for Daphne Spurlock, 45.

Authorities plan to interview family members to determine which relative would be best suited to care for Michael upon his recovery. His father is not being considered as a guardian, due to officials' fears that he could not keep Michael safe.

A visitation schedule for relatives is being worked out by CPS.

Another hearing is scheduled for May 16.
