Fight between brothers ends in fatal shooting

HOUSTON

He did not want to talk on camera, but we spoke with the man who shot his brother, who said he did it in self-defense. He has not been arrested or charged in this case.

The two lived next door to one another on a rural property at Pleak Crossing and Mulberry Circle. On Friday morning, you could still see the damage the two brothers fought over.

Investigators tell us at about 12:15am Friday, 63-year-old Santiago Montoya called 911, saying he'd been fighting with his brother, 52-year-old Ruben Montoya, and he feared that Ruben might come back and he needed law enforcement there.

Ruben did return, and during a struggle, Santiago shot and killed him with a handgun. The Ft. Bend Co. Sheriff's Office says Santiago is cooperating, and that this case will be referred to a grand jury.

When we spoke with the sheriff's office, they pointed out that Ruben was much younger and larger than Santiago. Santiago told us this was not the first trouble he'd had with his brother, and that his brother had a history of substance abuse.
