Martha Mirella Garza, 44, is facing a felony charge over the incident that took place on Halloween. Authorities say Garza locked three children out of the apartment in the 9200 block of Nathaniel and left them on the balcony alone. The children, ages 9, 8 and 3 were locked out for at least 45 minutes.
The Houston Fire Department arrived with a ladder to rescue the children. At the same time, Garza arrived back on the scene. It's not clear where Garza went, but she didn't leave anyone in charge of the children.
Bail in the case has been set at $35,000. Garza told the judge she plans to hire a lawyer.
