A Houston police statement on Thursday says Abraham Amador is charged with capital murder in the death of 48-year-old Rosalio Pena on Sept. 28.
Police say neighbors heard Pena arguing with a man outside his home. Then they heard two gunshots and saw a man they did not know running away.
Pena was taken to a hospital where he later died.
Police, who arrested Amador on Wednesday, say he told investigators he was trying to rob Pena.
Amador could not immediately be reached for comment.
