Defendant takes stand over officer death

DALLAS, TX Defense attorneys Tuesday began questioning Charles Payne, who's charged with capital murder in the 2009 death of Sr. Cpl. Norm Smith.

His lawyers previously said Payne thought his apartment was being robbed when gang unit officers tried to enter and arrest another man on an aggravated robbery warrant.

WFAA-TV reports Payne also testified he was brought up by his mother and his grandmother and that he's worked for a tile company and for a dairy operation.

Payne was expected to be the last defense witness, to be followed by closing arguments and then jurors starting deliberations.
