The family of a Texas man fatally shot by police while allegedly driving toward officers during a downtown brawl has filed a $10 million federal lawsuit. The civil rights lawsuit is on behalf of survivors of 24-year-old Claudio Trujillo of Amarillo.

A Potter County grand jury last week found no wrongdoing by Amarillo police during the incident early Jan. 30. Police have said that Trujillo refused to stop. He died several days after being shot multiple times.

The Amarillo Globe-News reported Wednesday that the lawsuit accuses police of gross negligence, excessive force and failure to properly train officers.

Trujillo family attorney Jesse Quakenbush the city was asked to settle the case but refused.

City Attorney Marcus Norris said late Tuesday he had not yet seen the lawsuit.
