Hearing to look at DNA from 1986 sex assault case

A hearing Thursday could be the next step toward freedom for a Dallas man convicted of sexual assault 25 years ago. State District Judge Gracie Lewis will consider recent DNA testing in the case of Larry Sims. A Dallas County prosecutor and Sims' attorney agree that the testing indicates flawed testimony sent the 61-year-old man to prison.

The prosecutor has indicated his office won't oppose an effort by Sims to seek a pardon or a writ that could lead to the conviction being overturned.

A favorable decision Thursday could allow Sims to be out on bail.

The victim testified that she didn't have sex with another man at a party, but the test found DNA from that man and not Sims.
