An attorney for a woman accused of doing nothing as her boyfriend beat his son to death says her client is "upset" at the charges filed against her and that she had tried to help the boy in the past. Thirty-year-old Tammyra Sampson, appeared before Judge Belinda Hill in Houston court Tuesday on the felony charge of injury to a child by omission.

Her boyfriend, 34-year-old Alex Duncan, also appeared, charged with murder in the beating death of his 6-year-old son.

Police said the boy was beaten for eight hours Saturday until he had a seizure and died and that Sampson witnessed the beating.

Cary Hart, Sampson's court-appointed attorney, said outside the courtroom that her client is "very upset."

Duncan's attorney, Thomas Martin, declined comment.
