Lawsuit tossed in cop shooting case

HOUSTON Susan Carnaby had sued the City of Houston, police Sergeant Andrew Washington and Officer Cecil Foster, who each shot at her husband. A grand jury cleared the officers last year.

In this recent ruling, the judge said the patrol car video clearly shows Roland Carnaby reaching under the seat of the SUV just after opening the door. The judge said that was the moment the officers were justified in applying deadly force because they reasonably feared for their lives.
