Victim's husband speaks out on wife's murderer

HOUSTON It was the news an east Houston family had been waiting to hear one year and four months. The man allegedly caught on tape, fatally stabbing a mother trying to protect her baby, was in custody.

"I'm just so excited and glad that it didn't take as long as I thought it would be," said the victim's husband Billy Brewer.

The man who has haunted Brewer in this surveillance video is now under arrest. On April 16, 2008, police say Timoteo Rios tried to carjack Tina Davila as she went to pay her cell phone bill at an east Houston store. Davila tried to stop the attacker from stealing her SUV because her baby was in the back seat. She was stabbed to death.

Days later, the alleged getaway driver was caught. But it took over a year of police work and hundreds of Crime Stoppers tips to track down Rios in Mexico, where he is now in custody.

Brewer is anxiously awaiting his arrival to Harris County.

"I want to see him like I did the other one and I got a few things, a few words I gotta say to make sure he knows what he did was wrong," said Brewer.

Brewer says the murder of Davila has left the family devastated. Her baby is now a toddler and times have also been tough for Davila's older children as well. He says he hopes Rios is dealt with a heavy hand.

"I want him to be just like she is. She's gone, so he should be gone. We'll leave that up the system and we'll go from there," said Brewer.

Unfortunately for Brewer, in order to get the extradition of Rios from Mexico to Harris County, prosecutors will have to agree to not seek the death penalty. His extradition could take up to 60 days or longer if Rios fights it.

Also arrested with Rios in Mexico was his uncle who is wanted for a murder charge in Harris County.
