Judge orders young Gitmo detainee's release

WASHINGTON U.S. District Judge Ellen Huvelle's order Thursday does not end the case of Mohammed Jawad, however. Government attorneys told the judge while the United States is negotiating with his home country of Afghanistan for his return next month, they are also pursuing a criminal investigation.

They say Attorney General Eric Holder has not yet decided whether to indict Jawad, who allegedly threw a grenade that wounded two U.S. soldiers and their interpreter in December 2002. That means it's possible he could be brought to the United States for a criminal trial.
