The boy is accused of fatally injuring an 11-month-old baby by throwing it last March. During a detention hearing Monday, the boy's family asked a judge to put him in his aunt's custody, but the judge ruled he should remain in a juvenile detention facility until the next hearing. The judge wanted a guarantee that the child would have 24 hour supervision.
Tawanna Scott, the suspect's mother, said, "(We're) disappointed. We have to do something else to make him come home. So it will be done."
The boy's relatives claim one of the victim's siblings is the real killer. The next detention hearing is scheduled for Tuesday morning.
