Smith tells Eyewitness News this is related to a recent reported sex assault in the Waller County jail and the theft of guns from his official vehicle in 2015.

Smith said he spoke with the judge and DA about their request. Smith claimed that it was suggested he stole the guns himself. He called that claim idiotic and said he is not resigning.
Waller County DA Elton Mathis said neither he nor Judge Duhon believe the sheriff was involved in the theft of the guns. Mathis is looking ahead to a positive resolution.
"The sheriff has assured me that he believes he can make the necessary changes the jail needs," Mathis told Eyewitness News. "I am hopeful that he will and I believe he realizes the seriousness of the situation."
