The father of the three children, Domingo Quintana, 61, was bonded out from the Liberty County Jail on Wednesday afternoon after he was arrested and charged with animal cruelty on Tuesday, which was unrelated to the near-drowning incident, according to the Liberty County Sheriff's Office.
On Wednesday, ABC13 was outside the jail, where Quintana didn't comment as he exited. He covered his face with papers and was then picked up in an SUV.
The sheriff's office said on Monday morning that deputies responded to a call for a possible drowning at a Liberty County property.
According to law enforcement, Quintana called 911 and said his children and their mother were by the water and that it was possible she was trying to do something to the kids.
When deputies arrived, they said they found the mother still in a pond, and the three children wet and out of the water.
According to the sheriff's office, Quintana told investigators he got his children out.
Deputies said that all three children have been medically released and are waiting to be discharged from the hospital. Authorities said that the three children involved were a 15-year-old, 11-year-old, and 6-year-old. Officials said the children will be in the custody of Child Protective Services.
The children's mother, who is 39 years old, remains in the hospital, where she is now stable after being in critical condition, officials said.
The sheriff's office said investigators are working with the district attorney's office and the Texas Rangers on the near-drowning case as an investigation is still ongoing.
