Suspect shot by HPD officers assaulted mother, took car moments before incident, police says

HOUSTON, Texas (KTRK) -- The suspect injured by police in Highland Village has been arrested and charged with unauthorized use of a motor vehicle in connection with the incident, according to the Houston Police Department.

Jamarcus Oneal Spates, 30, is accused of assaulting his mother and taking her vehicle without her permission from the Fort Bend County area, according to court documents.

On Monday at about 7:30 p.m., an off-duty, out-of-uniform officer was working an extra job at a business in the 4000 block of Westheimer and reported spotting a suspicious vehicle parked in the area. Once reported, uniformed, on-duty HPD officers arrived and attempted to conduct a traffic stop on the parked vehicle.

Police said Spates refused multiple commands to get out of the vehicle and remained inside for an extended period. Eventually, police made a coordinated approach, at which officers believed Spates opened the driver's door and extended his arm in a shooting position. As a result, HPD said nine officers discharged their weapons, and Spates was grazed by a bullet.



The case is being investigated by the HPD Special Investigations Unit, Internal Affairs Division, and the Harris County District Attorney's Office.
