Carlos Palacios, 18, was arrested and charged with invasive visual recording after the alleged incident at the Kroger store on West Sam Houston Parkway near West Road on Oct. 21, according to the sheriff's office.
Court documents state that a woman was shopping with her daughter in the dairy section when the daughter saw Palacios point his phone up her mother's dress and record video. Records say the daughter confronted him right away and reported the incident to store management.
The court documents also say that surveillance video captured the confrontation with Palacios. The footage then reportedly shows him removing his jacket, which revealed his name on his employee badge.
Sheriff Ed Gonzalez said Palacios was arrested on Wednesday. His bond was set at $5,000, which he has posted.
Kroger told ABC13 that they are taking the situation seriously and that Palacios no longer works for the company.
Palacios is scheduled to appear in court on Thursday.
