Request denied to remove judge on Peterson case
A prosecution request to remove the judge handling the felony child abuse case against Minnesota Vikings star Adrian Peterson has been denied

CONROE, TX (KTRK) -- The motion to have a Montgomery County judge taken off the case of NFL star Adrian Peterson was denied Wednesday afternoon.

A visiting judge rules that there is no legal basis to grant the district attorney's request.

Prosecutors accuses Judge Kelly Case of making unsolicited derogatory comments about District Attorney Brett Ligon on at least two occasions. They also point to a history of bad blood between the two.

Prosecutors also referenced a media interview Judge Case did in the office of one of the attorneys on Peterson's defense team. That story reportedly called Judge Case and the attorney longtime friends.

The defense says allegations that the judge must be recused in this high-profile case are based on the DA's personal feelings toward the judge, and a misguided belief that recusal is warranted because the two are he best of friends.

Now that this is settled, Judge Case can move forward on whether to approve or deny a motion to revoke Peterson's bond. Peterson admitted to smoking marijuana while out on bond.

Trial is scheduled for December 1.
