Police: 2 missing Freeport babies found safe

FREEPORT, Texas (KTRK) -- The two missing Freeport babies at the center of an Amber Alert have been found safe this morning.

An Amber Alert was issued overnight for 17-month-old Dominic Smith and 6-month-old Daniel Smith.

The children were with their parents, Ryan and Ashley Smith. Reporter Courtney Fischer learned that CPS was investigating them for child abuse.

Ryan was located just before 5 a.m. with the red Jeep. Ashley willingly surrendered the children a short time later. Eyewitness News was live from the Freeport Police Department when the children arrived safely.

The babies arrived at the Freeport Police Department after they were allegedly abducted by their mother.

"We want to thank all those who helped make this good outcome possible," Freeport police posted on its Facebook page with a photo of officers with the children.

On Thursday, the court issued an order for CPS to take custody of the children after allegations of abuse. Ryan said that he didn't agree with the court and that's why they fled. Ryan claims he did not abuse his children.

Fischer asked Ryan why they took the children.

"To protect them, because CPS is just going to hurt them. They ripping my kids from my family. They did it to my first son, which is 2-years-old and weighs 20 pounds. They are not meeting his physical needs or emotional needs," Ryan said.

The children are now in CPS custody. Police say the parents will not be charged.

The father told Courtney Fischer that he did not agree with a CPS court order, so he and his wife took them.
