Five children have been placed in CPS custody after a traffic stop involving their parents. Both parents now face charges

HOUSTON (KTRK) -- Five children have been placed in CPS custody after a traffic stop involving their parents. Both parents now face charges.

Police say around 1am, an off-duty officer was working special duty in a construction zone at Highway 290 and Tidwell. The officer saw the driver inside the barricade with damage to his car.

He says he saw a woman identified as Theresa Cua, 36, on the passenger side with a baby in her lap. Four other children, whose ages range from 2 to 5, were also in the car. Cua and the father, James Cruz Moreno, 33, are believed to have been drunk at the time. Police say Moreno was behind the wheel.

"As the officer was walking up, he said one of the children actually tried to throw a beer out of the window," said Lt. Larry Crowson with HPD. "There were several open beers in the car."

Authorities say none of the kids were properly restrained in the vehicle.

Cua is charged with child endangerment. Moreno is charged with felony DWI with a child in the car.

CPS will be involved in where the children are placed.
