HOUSTON (KTRK) -- An alleged would-be robber is dead and a second suspect wounded.

It happened on Majestic Street in northeast Houston.

Police say the suspects are teenagers, just 15 and 16 year old, and they apparently tried to rob a father and son. But what the suspects did not know was that son had just bought a gun.

This happened around 8:30pm in the back yard of the victim's home.

The son was showing his father the new gun he had just bought.

The two teenage suspects came into the back yard. One suspect pulled out his own gun and that is when the son used that new gun for the first time.

"One of the suspects pulled out a pistol, and that's when our complainant opened fire, striking the suspect," says HPD's Thomas Simmons. "The second suspect fled the scene."

That second suspect was shot too but made it home where his parents called an ambulance. He is expected to survive his injuries.

The case will now be handed over to a grand jury to determine if the boy who lived will face any criminal charges.
