Grand jury no bills suspect in dog park shooting

HOUSTON (KTRK) -- Another grand jury decision garnering harsh criticism from the Harris County district attorney herself.

Devon Anderson made it clear she is not happy with a grand jury's decision not to indict a local man accused of shooting and killing a dog at a park.

In January, 26 year-old Joseph Potts was charged with animal cruelty after police said he shot and killed a Staffordshire terrier named Diesel.

Potts claimed the dog threatened his dog and his family. But the DA's office says they proved otherwise and this case should've gone to trial.

"I can talk about the evidence we accumulated, which was about five witnesses who were at the dog park who gave sworn statements saying that from what they saw, the defendant was not being threatened by the dog. Nor was his wife nor was his dog which is what he claimed," Anderson said.

Anderson says she will continue to aggressively prosecute animal cruelty cases.
