Grand jury extended to complete open meetings case in county

The Montgomery County grand jury hearing evidence regarding the investigation into whether violations of the Texas Open Meetings Act occurred during negotiations for the November road bond will be extended 90 days.

Judge Lisa Michalk, of the 221st state District Court, on Thursday signed the order for the extension. Houston-based special prosecutor Chris Downey is investigating and presenting evidence.

"In an effort to keep going forward with the momentum that has occurred, it would be prudent to do so rather than introduce a set of new people to a very complicated problem," Downey told The Courier Thursday.

The investigation involves dozens of emails sent between Texas Patriots PAC treasurer Bill O'Sullivan and political consultant Marc Davenport in early August with certain county commissioners and the county judge being kept apprised of ongoing negotiations to place the November 2015 road bond referendum on the ballot.
