Family seeks harsher charges against suspect in deadly DWI
The family of man killed by an accused drunk driver want to know why no charges have been filed in connection to his death

HOUSTON (KTRK) -- The family of man killed by an accused drunk driver want to know why no charges have been filed in connection to his death.

Wesley Mein, 22, was walking his bike along the East Freeway feeder road near Channelview Tuesday night when he was struck and killed. Billy Richey Jr, 55, stopped and called for help. The Harris County Sheriff's Office says he was found to be intoxicated and was charged with DWI. Mein's family says that's not harsh enough.

"He was drinking and he got in a car. That's the same as taking gun and shooting someone," said Polly Jonas, Mein's aunt.

They believe he should be charged with killing Mein.

"He should be charged with killing my baby. He killed him," said victim's mother Melinda Leviness with tears streaming down her face.

A spokesman with the Harris County District Attorney's Office says the Vehicular Crimes Division hasn't yet received the case from the Sheriff's Office, but when they do, it's possible charges could be upgraded.
