HOUSTON (KTRK) --It will be another 45 days before we find out if the man who allegedly killed a Harris County Sheriff's deputy will stand trial.
State mental health doctors say that Shannon Miles is mentally competent to stand trial for the murder of Darren Goforth, but defense attorneys disagree and now the defense will get a chance to have their own doctors examine Miles.
Attorney Anthony Oso told the judge in the case that Shannon Miles still does not understand the basics of the case and even though a state doctor said Miles is able to go to trial, the judge is allowing an independent doctor to examine Miles.

The defense has until January 12th to come up with its evidence supporting their claim that Miles cannot participate in a meaningful way in his own defense.
If that independent doctor agrees with the defense, then ultimately a jury will have too determine if Miles is mentally competent to stand trial or not.
Shannon Miles is charged with capital murder for the shooting death of Deputy Darren Goforth, we will have to wait until January to see if the case goes forward or if a competence trial happens first.
