A ruling that would have paid out $2 million to residents in the neighborhood of the proposed development was overturned.

A Texas appeals court has overturned a 20 to 14 ruling related to the proposed Ashby high rise near Rice University.

The original ruling called for the developer to pay nearly $2 million in damages to people living within one block of the high rise.

Those damages would only be paid if the building is built.

The property, however, still sits empty.
