Hung Truong was charged in 2008 for a crash that killed Officer Gary Gryder. He was found not guilty by reason of insanity, and sent to a state mental hospital.
The Mental Health Authority is recommending outpatient treatment for him.
The hearing was moved to May 21. The Harris County District Attorney's Office is going to fight to keep Truong off the street.
