Jurors in El Paso on Thursday acquitted Spec. Tyrone Head. The defense said Head fired into the air during the January 2012 incident and did not shoot anyone.
Prosecutors say Head was charged with murder because his actions served as a threat that led to the deaths of the two privates. The victims were Preston Brown and Damien Bailey.
Investigators say the confrontation involved Head and some friends and a group with Craig Allen Graham. Witnesses testified Head fired into the air and Graham returned fire -- allegedly shooting Brown and Bailey.
Graham has been charged with capital murder and awaits trial.
