The Texas Court of Criminal Appeals on Wednesday ruled there was sufficient evidence to support David Temple's conviction.
Temple was sentenced to life in prison for the murder. Prosecutors accused him of staging the crime to look like a burglary and killing his wife because of an affair he was having with another woman, whom he later married.
His attorneys have asked for a new trial, claiming new evidence implicates a then teenage neighbor.
But in its ruling, the appeals court said that information about this other suspect was presented at trial and Temple was still convicted.
