Dustyn Roff, 4, died back in December. Initially his mother's boyfriend, 21-year-old Michael Allen Seaton, was charged in the murder. Investigators said Seaton beat Roff after an argument with his mother, Britni Glover. She was charged with injury to a child by omission, for failing to protect her son.
Now a Harris County Grand Jury has indicted Glover, 23, on a capital murder charge. According to court documents, Glover intentionally caused the death of her son by striking him with an unknown object.
Back in December, Glover told Eyewitness News she wasn't aware of Seaton's previous conviction for abusing a two-year-old girl.
We also learned CPS had two previous reports of abuse involving the mother and child, but a CPS spokeswoman says when they followed up, they could never find the two.
No bond has been set.
