The offenses allegedly took place back in February 2010 when the boy was just four years old. He told authorities that Jose Herrera, who was then 20 years old, kissed and touched him while Herrera's mother was babysitting the boy and another little girl.
Court documents state that the little girl told officials she saw Herrera kiss the victim "like a man kisses a woman" and call the boy into his bedroom.
The boy's mother said she noticed behavior problems and took the boy to a doctor, who referred the child to a psychologist. The boy finally told his mother about the sexual assault in January 2011.
Herrera, now 22, told police the boy was "very annoying" and had a bad habit of jumping into his bed with him to play around and annoy Herrera while he was sleeping. Court documents state Herrera admitted to touching the boy sexually.
Herrera has been charged with indecency with a child. Bail has been set at $70,000.
