Police have made a new arrest in the shooting death of a tow truck driver nearly three years ago to the day.

Jose Hernandez-Garcia, 24, is now charged with capital murder. According to court documents, investigators say Hernandez-Garcia admitted that he, Edgar Ivan Padron-Garcia, and another suspect tried to rob wrecker driver Mario Ramirez Jove in the 7000 block of Hillcroft in September of 2008. Hernandez-Garcia told investigators that they tried to rob Jove of his camera and wallet.

Court documents state Padron-Garcia ended up shooting Jove in the back as he tried to flee. Jove died from four gunshot wounds to the back.

Padron-Garcia, 31, is already behind bars for a different murder that happened on New Year's Eve 2010. In that case, an innocent customer was gunned down during a robbery at a convenience store.

Padron-Garcia also now faces charges in Jove's murder.
