HOUSTON --A man is accused of sexually assaulting a woman in her apartment while her two children slept in the other room. Marlon Jovel Hernandez is charged with aggravated sexual assault of an adult. According to court documents, the female victim was asleep with her children at her southwest Houston apartment on Town Park on November 18 of last year. The victim stated that she went to the bathroom around 2am and heard a noise coming from her kitchen. As she walked out of the bathroom and into her living room, she says an unknown Hispanic male came from behind the bathroom door and grabbed her. Court documents say the suspect pushed her onto the living room sofa, struck her and choked her while telling her that he would kill her if she did not cooperate. He then reportedly sexually assaulted her. Afterwards, the suspect fled through a window in the kitchen area. Following up on a tip, police took saliva swabs from Hernandez five days later. Police compared the DNA from Hernandez's saliva with the DNA from the rape kit exam and there was a match. Hernandez, 23, is being held on $50,000 bond.
