A teaching assistant has been charged with allegedly having sex with one of her underage high school students. Andrea Guadalupe Berbel, 28, is charged with one count of an improper relationship with a student and two counts of sexual assault of a child. The alleged victim was a 16-year-old male student at Robert E. Lee High School in west Houston.

According to court documents, Berbel was a teaching assistant at Lee High when she befriended the teenager in November 2009 while she was tutoring him. The student said the two became flirtatious and they would talk about sex. Over winter break in December 2009, the teen asked Berbel to come over to a friend's apartment where they had sex.

Berbel and the teen had sex on at least one other occasion in January 2010, the documents state. Then two students witnessed Berbel and the 16 year old embracing and kissing at school. The two witnesses reported the incident to school personnel.

Berbel is being held on $30,000 bond.

A spokesperson with HISD says Berbel is no longer employed by the school.

We did speak with the 16-year-old's mother. She tells us it happened 11 months ago and she has since forgiven the teacher.
