Company must destroy misbranded drugs

HOUSTON Texas Attorney General Greg Abbott on Thursday announced the final judgment to prevent misbranded or counterfeit drugs from being unlawfully distributed.

The Department of State Health Services investigated Medical Discount Pharmacy L.P. The legal action also includes Lifechek Inc. and two retail pharmacies. The AG's office says Medical Discount Pharmacy and Lifechek are owned by pharmacist Bruce Gingrich of Rosenberg.

Medical Discount Pharmacy must destroy, through the use of a licensed drug salvager, products that have been seized by the state, plus pay nearly $85,000 in penalties, legal fees and investigative costs.

Rosenberg pharmacist Bruce Gingrich owns both businesses and told Eyewitness News the state mistakenly said he misbranded one bottle of Lipitor, which did not get sold.
