Brownsille mayor's retrial delayed until March

BROWNSVILLE, TX Ahumada on Tuesday was scheduled for retrial in Brownsville. His first trial ended in October with a mistrial when jurors failed to reach a unanimous decision.

Ahumada has said in 2008 he accidentally deposited the city check intended for a vendor into his personal business account.

Ahumada was charged with theft, abuse of official capacity and misapplication of fiduciary property. He denied the allegations and called the deposit a "mistake."

Visiting State District Judge Robert Pate, who has issued a gag order in the case, granted the continuance Friday in a delay sought by Ahumada's lawyers. Further details were not released.

Jury selection begins March 22.
