Family feud ends in fatal shooting

HOUSTON The shooting happened overnight on Doulton Drive near Belgard Street in southeast Houston.

Officers say the two men were arguing over something rather trivial. The nephew reportedly left the house and then returned drunk to confront his uncle again.

Authorities say the nephew threatened his uncle with some sort of pipe, prompting the shooting. After the shooting, the uncle picked up the phone and called 911. He reportedly told operators, 'I had to shoot my nephew.'

"He's upset. He is upset. He is sorry it happened," said Detective Richard Martinez with the Houston Police Department. "It's basically a deal of self defense at this standpoint. It is a self defense issue."

Emergency crews found the nephew lying in the driveway of the house. He was rushed to Ben Taub Hospital where he was pronounced dead. He hasn't been identified.

Homicide detectives are interviewing a 14-year-old who apparently witnessed the incident. The uncle was taken into custody but has not been charged. Authorities say they don't plan on filing any charges, but the case will be reviewed by the grand jury.
