Authorities have said the California Polytechnic State University student died while being initiated into the Sigma Alpha Epsilon fraternity.
Autopsy results showed Starkey's blood-alcohol levels reached at least 0.39 percent. California's legal driving limit for blood-alcohol is 0.08 percent -- the same as Texas.
The fraternity has already been suspended.
