The fifth U.S. Circuit Court of Appeals ruled the judge in the trial of Dr. Gayle Rothenberg allowed prosecutors to use misleading, confusing and prejudicial evidence against Rothenberg. Her first trial ended in a hung jury and Rothenberg could face trial a third time.
