Murder charges filed in 16-year-old case

HOUSTON Obel Cruz-Garcia, 41, is charged with capital murder after allegedly killing six-year-old Angelo Garcia, Jr. According to police, back on September 30, 1992, the child was sleeping in his apartment at 6705 Fairway with his mother and step-father when at least two masked men forced their way inside.

The stepfather had gotten up to investigate the noise when one of the men forced him back into the bedroom. The stepfather was then beaten, bound and gagged and the mother was bound, blindfolded and allegedly sexually assaulted by one of the suspects.

After the mother freed herself, she and her husband went looking for Angelo, but he was nowhere to be found. Then on November 5 of that same year, skeletal remains of a young boy were found in Baytown, which were later confirmed to be those of Angelo.

Investigators identified Cruz-Garcia as a possible suspect at the time but could not locate him and felt he fled the country.

Then last year, biological evidence collected at the scene on the original date of the incident was sent to a private laboratory for analysis. A male's DNA profile was developed and with the assistance from the FBI, it was discovered Cruz-Garcia was in prison in Puerto Rico. A DNA sample was collected from and was found to match the evidence from the scene.

Cruz-Garcia is currently awaiting extradition to Houston, Texas.
