"She did not know she was giving birth to a child," said Yoakum. "There was, there's no evidence that she did anything intentional. This was a tragic accident."
Yoakum says his client never heard or saw the baby, that help arrived, and she was taken out of the bathroom quickly. The Harris County Medical Examiner's office is in charge of the autopsy, but does not yet have any details to release to the public.
