Accused baby killer returns to Houston

GALVESTON (KTRK) Travis "TJ" Mullis was returned to Galveston overnight, and did appear briefly before a judge this morning. Mullis appeared before a magistrate judge to take care of some paperwork and be formally told of a charge of a capital murder against him.

Later today, the district attorney in Galveston will meet with the investigators in charge of this case and will decide when this case will be presented to the grand jury.

Mullis didn't return to Texas until late last night, thanks to a snag with his flight from Pennsylvania. Galveston police attempted to escort Mullis back to Texas on a Southwest Airlines flight, but the airline does not allow handcuffs on the plane.

Officers were able to book a later flight with another airline that would allow Mullis on with handcuffs. The 21-year-old was transported from Philadelphia to Houston on a Continental Airline flight.

He was in Philadelphia after being on the run following the brutal death of his three-month-old son. The baby was found on the side of the road with head trauma last week.

According to an affidavit, Mullis walked into the Philly police department and confessed to the crime. However, investigators with the police department are not saying exactly what Mullis has told them.

"The only thing I am allowed to say is that it was a safe flight. It was a safe transport and he (Mullis) is in Texas now and that is about it," said Sgt. Jeremy Schwartz with the Galveston Police Department.

Eyewitness News has learned that the mother of the victim has now agreed to cooperate with the investigation. She had not been talking with investigators since she was informed of her child's death and she and her attorney will set up a time for further questioning.
